Assault and battery is a charge that indicates one person threatened another with physical harm and followed through with physical contact and, in some cases, injury. Broken down, an “assault” charge refers to the portion of the law where one person is threatening another with harm, whereas “battery” is when the person actually follows through with the threat. - A fine of up to $500, or both’

- A state prison sentence of up to 5 years; or
- A jail sentence of up to 1 year;
- A fine of up to $500; or both a fine and imprisonment
